In 2006, Milton Marcelin was murdered outside of a FEMA trailer in New Orleans’ St. Roch neighborhood. The state charged Kevin Harrison with second degree murder.
At trial, the state relied on the testimony of Darrick Jack. Jack, who died before Mr. Harrison’s trial, allegedly witnessed the murder. He heard the shooter ask Marcelin for money to which Marcelin replied “I ain’t giving you no money.” The shooter then shot Marcelin. The defense argued that the prosecution failed to investigate other potential suspects. And, in the absence of clear evidence, the police quickly drummed up Jack as a witness in order to make their case. Following three hours of deliberations, the Orleans Parish jury acquitted Mr. Harrison.
